Section 125 — Employment Relations Act 2000: Reinstatement to be primary remedy

125 Reinstatement to be primary remedy (1) This section applies where— (a) the remedies sought by or on behalf of an employee in respect of a personal grievance include reinstatement (as described in section 123(a) ); and (b) it is determined that the employee did have a personal grievance. (2) If this section applies the Authority must, whether or not it provides for any of the other remedies provided for in section 123 , provide, wherever practicable, for reinstatement as described in section 123(a) .
