Section Sch4-25 — Employment Relations Act 2000: Application of criteria

25 Application of criteria In applying the criteria, the arbitrating body— (a) is not bound by historical precedent and practice of any sort; and (b) must consider whether relativities or conditions of employment should be changed to take account of factors that are specific to the work covered by the proposed agreement; and (c) is not to have any regard whatsoever to any matters that remained in dispute but were not matters that may be fixed under section 67(3).
