“ 96 Employment Relations Act 2000 and State Sector Act 1988 not to apply “ (1) Except as otherwise expressly provided in this Act, nothing in either the Employment Relations Act 2000 or the State Sector Act 1988 applies to any persons employed as members of the Police under this Act. “ (2) Subject to this Part,— “ (a) sections 139 and 140 of the Employment Relations Act 2000, with any necessary modifications, apply to the non-observance of or non-compliance with any provision of this Part of this Act or of an agreement under this Act: “ (b) if any person wishes to apply for review under Part 1 of the Judicature Amendment Act 1972, or bring proceedings seeking a writ or order of, or in the nature of, mandamus, prohibition, certiorari, or declaration or injunction, in relation to the exercise, refusal, or proposed or purported exercise by any person or body of any power under this Part of this Act, the provisions of subsections (2) to (4) of section 194 of the Employment Relations Act 2000 apply: “ (c) Part 11 of the Employment Relations Act 2000 applies to proceedings before the Employment Court under this Part as if those proceedings were proceedings under that Act. ”
