Section 38 — Fair Trading Act 1986: Jurisdiction of District Courts

38 Jurisdiction of District Courts In accordance with this Part of this Act, the District Courts shall hear and determine the following matters— (a) Proceedings for offences against sections 40 and 47J of this Act: (b) Applications for orders under sections 40A , 42 , and 43 of this Act. Paragraph (a) was amended, as from 8 July 2003, by section 7(a) Fair Trading Amendment Act 2003 (2003 No 31) by substituting the words “ sections 40 and 47J ” for the expression “ section 40 ” . See section 16 of that Act as to proceedings already barred and pending proceedings. Paragraph (b) was amended, as from 8 July 2003, by section 7(b) Fair Trading Amendment Act 2003 (2003 No 31) by substituting the words “ sections 40A, 42, and 43 ” for the expression “ section 43 ” . See section 16 of that Act as to proceedings already barred and pending proceedings.
