Section 155 — Family Proceedings Act 1980: Applications by agents

155 Applications by agents (1) A person who may apply for a maintenance order under this Act may do so by an agent authorised in writing by that person. (2) If a person is incapable of authorising an agent under subsection (1) of this section to make an application on that person's behalf— (a) The manager of that person's estate under the Protection of Personal and Property Rights Act 1988 may make the application; or (b) Where there is no such manager, the next friend of the person may make the application. Compare: 1968 No 62 ss 25, 31(1), (3); 1971 No 59 ss 3, 4 Subsection (2)(a) was amended, as from 1 October 1988, by section 113 Protection of Personal and Property Rights Act 1988 (1988 No 4) by substituting the words “ the Protection of Personal and Property Rights Act 1988 ” for the words “ Part 7 of the Mental Health Act 1969 or under the Aged and Infirm Persons Protection Act 1912 ” .
