Section 187 — Family Proceedings Act 1980: Regulations

187 Regulations The Governor-General may from time to time, by Order in Council, make regulations— (a) Prescribing expenses to be paid to any person summoned under section 17 of this Act, and prescribing by whom those expenses shall be paid: (b) Prescribing the matters in respect of which fees are payable under this Act: (c) Prescribing fees and expenses for the purposes of this Act: (ca) Making provision for the determination of the amount of fees and expenses, including minimum and maximum amounts, payable in respect of counselling services carried out pursuant to section 9 or section 10 or section 19 of this Act, which fees and expenses may differ according to the number of sessions of counselling determined to be carried out pursuant to section 12A of this Act and according to whether or not counselling services are to be provided in a specified number of proceedings during a specified period: (cb) Making provision for the determination of the amount of fees and expenses, including minimum and maximum amounts, payable in respect of professional services provided by barristers and solicitors appointed under section 162 of this Act, which fees and expenses may differ according to the complexity of the proceedings and the time spent, and according to whether or not professional services are to be provided in a specified number of proceedings during a specified period: (cc) Making provision for the determination of the number of sessions of counselling that may be carried out pursuant to section 9 or section 10 or section 19 of this Act: (d) Prescribing parentage tests to be carried out for the purposes of sections 54 to 57 of this Act: (e) Prescribing the manner in which such parentage tests are to be carried out: (f) Prescribing the form of reports on parentage tests: (g) Providing for such matters as are contemplated by or necessary for giving full effect to this Act and for its due administration. Compare: 1968 No 62 ss 16(5), 50(8), 131 Paragraph (c) was substituted, as from 1 July 1992, by section 27 Family Proceedings Amendment Act 1991 (1991 No 144). Paragraphs (ca), (cb), and (cc) were inserted, as from 1 July 1994, by section 15 Family Proceedings Amendment Act 1994 (1994 No 32). Paragraphs (d) to (f) were amended, as from 1 July 2005, by section 150 Care of Children Act 2004 (2004 No 90) by substituting the word “ parentage ” for the word “ blood ” .
