Section 107 — Health and Safety at Work Act 2015: Compliance with prohibition notice

107 Compliance with prohibition notice (1) A person to whom a direction is given under section 105(2) or to whom a prohibition notice is issued must comply with the direction or notice. (2) A person who contravenes subsection (1) commits an offence and is liable on conviction,— (a) for an individual, to a fine not exceeding $100,000: (b) for any other person, to a fine not exceeding $500,000. (3) It is not an offence to fail to comply with recommendations in a prohibition notice. Compare: 1992 No 96 s 43 ; Model Work Health and Safety Act (Aust) s 197
