Section 192 — Health and Safety at Work Act 2015: Role of designated agencies

192 Role of designated agencies (1) If a designated agency has been given a scope of designation under section 191 , WorkSafe or another agency may perform functions or exercise powers under this Act or any other enactment in respect of the scope of designation only if the designated agency has given its consent for WorkSafe or the other agency to do so. (2) A designated agency or its inspectors must not perform any functions or exercise any powers in respect of a matter that is outside its scope of designation unless WorkSafe (or, if relevant, another designated agency) has given its consent for the designated agency to do so. (3) However, a failure to obtain consent under subsection (1) or (2) does not affect the validity of the performance of any function or exercise of any power by WorkSafe or another agency or by the designated agency (as the case may be).
