205 Requirements for authorisation of plant or substance (1) A person must not use plant or a substance at a workplace if— (a) regulations require the plant or substance or its design to be authorised; and (b) the plant or substance or its design is not authorised in accordance with regulations. (2) A PCBU must not direct or allow a worker to use plant or a substance at a workplace if— (a) regulations require the plant or substance or its design to be authorised; and (b) the plant or substance or its design is not authorised in accordance with regulations. (3) A person who contravenes subsection (1) or (2) commits an offence and is liable on conviction,— (a) for an individual, to a fine not exceeding $20,000: (b) for any other person, to a fine not exceeding $100,000.
