Section 27 — Health and Safety at Work Act 2015: PCBU must not levy workers

27 PCBU must not levy workers (1) A PCBU must not impose a levy or charge on a worker (or permit a levy or charge to be imposed on a worker) for anything done, or provided, in relation to health and safety. (2) For the purposes of subsection (1), a PCBU will be treated as having levied or charged a worker who is an employee of the PCBU if the PCBU requires the employee to provide his or her own personal protective equipment— (a) as a pre-condition of employment; or (b) as a term or condition in an employment agreement. (3) A person who contravenes subsection (1) commits an offence and is liable on conviction,— (a) for an individual, to a fine not exceeding $5,000: (b) for any other person, to a fine not exceeding $25,000.
