11 Exceptions to clauses 4(1) and 10(1) (1) Despite clauses 4(1) and 10(1) , a PCBU— (a) must not allow a health and safety representative to have access to any personal information concerning a worker without the worker’s consent unless the information is in a form that— (i) does not identify the worker; and (ii) could not reasonably be expected to identify the worker; and (b) is not required to give financial assistance to a health and safety representative for the purpose of the assistance referred to in clause 5 ; and (c) may refuse on reasonable grounds to grant access to the workplace to a person assisting a health and safety representative. (2) A person who contravenes subclause (1)(a) commits an offence and is liable on conviction,— (a) for an individual, to a fine not exceeding $10,000: (b) for any other person, to a fine not exceeding $50,000.
