Section 92F — Human Rights Act 1993: Proof of justified limits and exceptions

92F Proof of justified limits and exceptions (1) The onus of proving, in any proceedings under this Part, that an act or omission is, under section 5 of the New Zealand Bill of Rights Act 1990 , a justified limit on the right to freedom from discrimination affirmed by section 19 of the New Zealand Bill of Rights Act 1990 lies on the defendant. (2) The onus of proving, in any proceedings under this Part, that conduct is, under any provision of Part 2 , excepted from conduct that is unlawful under any provision of Part 2 lies on the defendant.
