Section 370 — Immigration Act 2009: Procedural provisions relating to offences

370 Procedural provisions relating to offences (1) An offence against section 342(1)(b) , 343(1)(a), (b), or (c)(i) , 345 , 348 , or 351 is punishable on indictment. (2) All other offences against this Act or any regulations made under it are punishable on summary conviction. (3) A prosecution for an offence against this Act or any regulations made under it cannot be commenced except on the information of an immigration officer, a constable, or some other person authorised for that purpose by the Minister.
