Section 462 — Immigration Act 2009: Immigration officers

462 Immigration officers (1) On and from the commencement of section 404 of this Act, immigration officers designated under section 133 of the former Act, including customs officers and other persons designated as immigration officers in accordance with paragraphs (b) and (c) of the definition of immigration officer in section 2(1) of the former Act, must be treated as immigration officers designated under section 388 of this Act who are authorised to exercise visa and entry permission decision-making powers. (2) On and from the commencement of section 404 of this Act, visa officers designated in accordance with paragraphs (b) and (c) of the definition of visa officer in section 2(1) of the former Act must be treated as immigration officers designated under section 388 of this Act who are authorised to make decisions relating to visas outside New Zealand. (3) A designation deemed to continue by subsection (1) or (2) may be revoked by the chief executive under section 391 of this Act. (4) Subsections (1) and (2) are subject to any condition imposed on the designation under the former Act.
