Section HA 17 — Income Tax Act 2007: Dividends derived by qualifying companies

HA 17 Dividends derived by qualifying companies What this section applies to (1) This section applies to a dividend— (a) that a company derives after it becomes a qualifying company; and (b) to which section CW 10 (Dividend within New Zealand wholly-owned group) applies. Dividend not exempt income (2) The dividend is not exempt income under section CW 10 , except to the extent to which section CW 9 (Dividend derived by company from overseas) applies to it. Defined in this Act: company , dividend , exempt income , qualifying company , Compare: 2004 No 35 ss HG 10(a) , HG 13(1)(aa) Section HA 17(1)(b): amended (with effect on 1 July 2011 and applying for income years beginning on or after that date), on 7 May 2012, by section 74(1) of the Taxation (International Investment and Remedial Matters) Act 2012 (2012 No 34). Section HA 17(2): amended (with effect on 1 July 2011 and applying for income years beginning on or after that date), on 7 May 2012, by section 74(2) of the Taxation (International Investment and Remedial Matters) Act 2012 (2012 No 34).
