102 Procedure in determining incapacity under section 103 or section 105 (1) The Corporation may determine any question under section 103 or section 105 from time to time. (2) In determining any such question, the Corporation— (a) must consider an assessment undertaken by a medical practitioner or nurse practitioner; and (b) may obtain any professional, technical, specialised, or other advice from any person it considers appropriate. Subsection (2)(a) was amended, as from 18 September 2004, by section 175(1) Health Practitioners Competence Assurance Act 2003 (2003 No 48) by omitting the word “ registered ” .
