123 Procedure on application for transmission (1) If on any such application and upon the evidence adduced in support thereof it appears to the Registrar that the applicant is entitled to the estate or interest claimed, the Registrar shall register the applicant as proprietor thereof. (2) The person so registered as proprietor shall hold the estate or interest transmitted subject to all equities affecting the same, but for the purpose of any dealing therewith shall be deemed to be the absolute proprietor thereof. Compare: 1915 No 35 s 124 Subsection (1) was amended, as from 1 February 1999, by section 43(1) Land Transfer (Automation) Amendment Act 1998 (1998 No 123) by omitting the words “ and Examiner of Titles ” and the words “ , with the concurrence of the Examiner, ” .
