140 Effect of caveat against bringing land under Act So long as a caveat under section 136 remains in force the Registrar shall not proceed with the bringing under this Act of the land affected thereby, nor shall it be lawful for the person making the application to withdraw the same except with the consent of the caveator or by leave of the High Court. Compare: 1915 No 35 s 149 The words “ High Court ” were substituted, as from 1 April 1980, for the words “ Supreme Court ” pursuant to section 12 Judicature Amendment Act 1979 (1979 No 124). Section 140 was amended, as from 17 May 2005, by section 12 Land Transfer Amendment Act 2005 (2005 No 58) by substituting the words “ under section 136 ” for the words “ in Form M ” .
