Section 180 — Land Transfer Act 1952: Limitation of actions

180 Limitation of actions (1) No action for recovery of damages as aforesaid shall lie or be sustained against the Crown unless the action is commenced within the period of 6 years from the date when the right to bring the action accrued; but any person being under the disability of infancy or unsoundness of mind may bring such an action within 3 years from the date on which the disability ceased. (2) For the purposes of this section, the date when the right to bring an action accrued shall be deemed to be the date on which the plaintiff becomes aware, or but for his own default might have become aware, of the existence of his right to make a claim. Compare: 1915 No 35 s 195; 1950 No 65 s 35(2) Subsection (2) was inserted, as from 30 September 1959, by section 5 Land Transfer Amendment Act 1959 (1959 No 29).
