Section 226 — Land Transfer Act 1952: Other offences under Act

226 Other offences under Act Every person commits an offence, and is liable on conviction on indictment to imprisonment for a term not exceeding 4 years, who— (a) Forges, or procures to be forged, or assists in forging the seal of any Registrar, or the name, signature, or handwriting of any officer of the Land Registry Office, in cases where that officer is by this Act or the Land Transfer Acts expressly or impliedly authorised to affix his signature; or (b) Stamps, or procures to be stamped, or assists in stamping any document with any forged seal of any Registrar or fraudulently stamps or procures to be stamped or assists in stamping any document with the seal of any Registrar; or (c) Forges, or procures to be forged, or assists in forging the name, signature, or handwriting of any person whomsoever to any instrument which is by this Act or the Land Transfer Acts, or in pursuance of any power contained in any such Act, expressly or impliedly authorised to be signed by that person; or (d) Uses, with an intention to defraud any person whomsoever, any document upon which any impression or part of the impression of any seal of any Registrar has been forged, knowing the same to have been forged, or any document the signature to which has been forged, knowing the same to have been forged; or (e) Fraudulently, or with intent to defraud, uses or deposits, or seeks to use or deposit, under this Act any power of attorney, knowing the same to have been revoked, whether expressly or by the death of the grantor; or (f) Knowingly or wilfully makes a false oath or declaration concerning any matter or procedure made and done in pursuance of this Act or the Land Transfer Acts; or (fa) Fraudulently copies, images, records, or registers any instrument or other document or information under the Land Transfer (Computer Registers and Electronic Lodgement) Amendment Act 2002 ; or (fb) Fraudulently does or omits to do any act for the purpose of copying, imaging, recording or registering any instrument or other document or information under the Land Transfer (Computer Registers and Electronic Lodgement) Amendment Act 2002 ; or (fc) Without being authorised by the Registrar to do so,— (i) Connects the computer system maintained under the Land Transfer (Computer Registers and Electronic Lodgement) Amendment Act 2002 to any other computer, or to any terminal or other installation connected to or forming part of any other computer; or (ii) Operates or attempts to operate that system (whether by means of any device or apparatus that is part of that system, or by any other means); or (iii) Alters that system or the programming of that system; or (iv) Alters any record on that system; or (g) Fraudulently enters or authenticates in the register any memorial or any part of any memorial, or fraudulently does or omits to do any act for the purpose of entering or authenticating, or procuring the entry or authentication, on the register of any memorial or any part of any memorial; or (h) gives a fraudulent certificate under section 164A . Paragraph (b) was amended, as from 7 October 1966, by section 15(1) Land Transfer Amendment Act 1966 (1966 No 37) by inserting the words “ or fraudulently stamps or procures to be stamped or assists in stamping any document with the seal of any Registrar ” . Paragraph (c) was amended, as from 1 June 2002, by section 65(1) Land Transfer (Computer Registers and Electronic Lodgement) Amendment Act 2002 (2002 No 11), by substituting the words “ the Land Transfer Acts ” for the words “ any former Land Transfer Act ” . Paragraph (f) was amended, as from 7 October 1966, by section 15(2) Land Transfer Amendment Act 1966 (1966 No 37) by inserting the word “ or ” . Paragraph (f) was amended, as from 1 June 2002, by section 65(1) Land Transfer (Computer Registers and Electronic Lodgement) Amendment Act 2002 (2002 No 11), by substituting the words “ the Land Transfer Acts ” for the words “ any former Land Transfer Act ” . Paragraphs (fa) to (fc) were inserted, as from 1 February 1999, by section 38 Land Transfer (Automation) Amendment Act 1998 (1998 No 123). Paragraphs (fa) and (fb) were amended, as from 1 June 2002, by section 65(1) Land Transfer (Computer Registers and Electronic Lodgement) Amendment Act 2002 (2002 No 11), by substituting the words “ any instrument or other document or information under the Land Transfer (Computer Registers and Electronic Lodgement) Amendment Act 2002 ” for the words “ any information under the Land Transfer (Automation) Amendment Act 1998 ” . Paragraph (fc)(i) was amended, as from 1 June 2002, by section 65(1) Land Transfer (Computer Registers and Electronic Lodgement) Amendment Act 2002 (2002 No 11), by substituting the words “ Land Transfer (Computer Registers and Electronic Lodgement) Amendment Act 2002 ” for the words “ Land Transfer (Automation) Amendment Act 1998 ” . Paragraph (g) was inserted, as from 7 October 1966, by section 15(2) Land Transfer Amendment Act 1966 (1966 No 37). Section 226 was amended, as from 1 June 2002, by section 65(1) Land Transfer (Computer Registers and Electronic Lodgement) Amendment Act 2002 (2002 No 11), by inserting the word “ ; or ” . Paragraph (h) was inserted, as from 1 June 2002, by section 65(1) Land Transfer (Computer Registers and Electronic Lodgement) Amendment Act 2002 (2002 No 11).
