Section 88 — Land Transfer Act 1952: Provision in case of lost lease or mortgage

88 Provision in case of lost lease or mortgage (1) The provisions of the last preceding section shall, as far as they are applicable and with the necessary modifications, apply to any lease or licence, or memorandum of lease, or memorandum of mortgage of which the outstanding duplicate has been lost, mislaid, or destroyed. (2) The same provisions shall, as far as they are applicable and with the necessary modifications, apply to any lease or licence, or memorandum of lease, or memorandum of mortgage of which the outstanding duplicate has become defaced or dilapidated and is surrendered to the Registrar for cancellation, but in that case the statutory declaration referred to in subsection (1) and the notices referred to in subsection (4) of the said last preceding section shall not be necessary.
