Section 11 — Official Information Act 1982: Exclusion of public interest immunity

11 Exclusion of public interest immunity (1) Subject to subsection (2) of this section, the rule of law which authorises or requires the withholding of any document, or the refusal to answer any question, on the ground that the disclosure of the document or the answering of the question would be injurious to the public interest shall not apply in respect of— (a) Any investigation by or proceedings before an Ombudsman; or (b) Any application under section 4(1) of the Judicature Amendment Act 1972 for the review of any decision under this Act; but not so as to give any party any information that he would not, apart from this section, be entitled to. (2) Nothing in subsection (1) of this section affects— (a) Section 31 of this Act; or (b) Clause 8 of Schedule 2 to this Act; or (c) Section 20(1) of the Ombudsmen Act 1975 . Subsection (1)(a) was amended by section 53(b) of this Act (as from the close of 30 June 1988) by omitting the words “ or the Authority ” .
