Section 71F — Parental Leave and Employment Protection Act 1987: Subsequent parental leave payments

71F Subsequent parental leave payments (1) An employee is not entitled to a parental leave payment if— (a) section 6 applies (restriction on taking of parental leave within 6 months of end of previous period of parental leave for another child); or (b) any of sections 8(2) , 18(2) , or 24(2) applies (restriction on adoptive parent taking parental leave if they have previously taken parental leave for the same child as a birth parent). (2) A self-employed person is not entitled to a parental leave payment in respect of a child if— (a) less than 6 months have elapsed after the end of the period for which the person received a parental leave payment; or (b) section 71CB(2) applies (restriction on adoptive parents receiving parental leave payments if they have previously received parental leave payments for the same child as a birth parent). Part 7A (comprising sections 71A to 71ZA) was inserted, as from 1 July 2002, by section 4(2) Parental Leave And Employment Protection (Paid Parental Leave) Amendment Act 2002 (2002 No 7). Paragraph (a) was amended, as from 1 July 2006, by section 27(1) Parental Leave and Employment Protection (Paid Parental Leave for Self-Employed Persons) Amendment Act 2006 (2006 No 20) by substituting the expression “ 6 months ” for the expression “ 12 months ” . See section 5 of that Act for the application of this amendment. Subsection (2) was inserted, as from 1 July 2006, by section 27(2) Parental Leave and Employment Protection (Paid Parental Leave for Self-Employed Persons) Amendment Act 2006 (2006 No 20).
