Section 72 — Parental Leave and Employment Protection Act 1987: Contracting out: holiday pay while on parental leave

72 Contracting out: holiday pay while on parental leave (1) Any employment agreement may, in addressing the matter of holiday pay for an employee who takes any period of parental leave otherwise than in accordance with this Act, provide that the employee is entitled to holiday pay,— (a) in respect of annual holidays, at the same rate as, or at a higher rate than, the rate referred to in section 42(2) : (b) [Repealed] (2) [Repealed] Section 72 was substituted, as from 15 May 1991, by section 11 Parental Leave and Employment Protection Amendment Act 1991 (1991 No 28). Section 72 was substituted, as from 1 July 2002, by section 19(1) Parental Leave And Employment Protection (Paid Parental Leave) Amendment Act 2002 (2002 No 7). Subsection (1)(b) was repealed, as from 1 April 2004, by section 91(2) Holidays Act 2003 (2003 No 129). Subsection (2) was repealed, as from 1 April 2004, by section 91(2) Holidays Act 2003 (2003 No 129).
