Section 100 — Privacy Act 2020: Apology not admissible except for assessment of remedies

100 Apology not admissible except for assessment of remedies (1) If an apology is given by an agency in connection with an action alleged to be an interference with the privacy of an individual, it is not admissible as evidence in any civil proceedings against the agency under this Part except as provided in subsection (2). (2) An agency may bring evidence of the apology for the purpose of the Tribunal’s assessing of remedies to be awarded against the agency.
