107 Interim order suspending Commissioner’s direction pending appeal (1) The Chairperson of the Tribunal may make an interim order suspending an access direction until an appeal is determined if the Chairperson is satisfied that it is necessary and in the interests of justice to make the order. (2) If an interim order is made, a party may apply to the High Court to vary or rescind the order, unless the order was made with that party’s consent. (3) An application under subsection (2) may be— (a) made only with the leave of the Chairperson: (b) made instead of, but not as well as, an appeal against the interim order under section 123(1) of the Human Rights Act 1993.
