Section 210 — Property Law Act 2007: Implied term of lease if no other term agreed

210 Implied term of lease if no other term agreed (1) This section applies to a lease if— (a) the lessee is in possession of the land, although the lessor and the lessee have not agreed, expressly or by implication, on the duration of the term of the lease; or (b) the lessee remains in possession of the land with the lessor’s consent, although the term of the lease has expired and the lessor and the lessee have not agreed, expressly or by implication, that the lessee may continue in possession for some other period. (2) A lease to which this section applies— (a) is terminable at will; and (b) may be terminated, at any time, by the lessor or the lessee giving not less than 20 working days’ written notice to the other party to the lease.
