287 When person executes instruments in fiduciary capacity for purposes of section 286 (1) For the purposes of section 286 , a person executes an instrument in a fiduciary capacity if that person executes the instrument as a trustee, as an administrator, as a manager of property of a person under the Protection of Personal and Property Rights Act 1988 , under an order of a court, or in any other fiduciary capacity. (2) For the purposes of section 286 , an instrument executed by Public Trust acting otherwise than as agent or attorney must be taken, in the absence of evidence to the contrary, to have been executed in a fiduciary capacity. (3) This section does not limit section 286 . Compare: 1952 No 51 s 75
