336 Further considerations relating to trees (1) A court determining an application under section 334 for an order for the removal or trimming of a tree under section 333 must have regard to the following matters: (a) the interests of the public in the maintenance of an aesthetically pleasing environment: (b) the desirability of protecting public reserves containing trees: (c) the value of the tree as a public amenity: (d) any historical, cultural, or scientific significance of the tree: (e) any likely effect of the removal or trimming of the tree on ground stability, the water table, or run-off. (2) Except for a purpose referred to in section 335(1)(b)(i) , the court may not make an order under section 333 relating to any tree that is the subject of a requirement lawfully made by a heritage protection authority under the provisions of Part 8 of the Resource Management Act 1991.
