Section 49 — Property Law Act 2007: Application of subpart

49 Application of subpart (1) This subpart applies to an assignment of a thing in action made only on or after 1 January 2008. (2) A thing in action that is not capable of being assigned cannot be assigned under this subpart. (3) However, subsection (2) applies subject to section 53 . (4) This subpart does not affect the application of section 18 . (5) If only part of a thing in action is assigned, the rights and obligations under this subpart of the assignor, the assignee, and the debtor relate only to the part assigned.
