Section 81 — Property Law Act 2007: Right of mortgagor to bring proceeding against mortgagee

81 Right of mortgagor to bring proceeding against mortgagee (1) A mortgagor of land may bring a proceeding against the mortgagee without first offering to redeem the mortgaged land. (2) Subsection (1) applies despite anything to the contrary expressed or implied in the mortgage. Compare: 1952 No 51 s 80B(2)
