12 Power to cancel lease for non-payment of rent or other breach (1) The lessor may cancel the lease in accordance with section 244 if— (a) any rent is unpaid for 15 working days after the due date for payment (whether or not a demand for payment has been made to the lessee by written notice signed by the lessor or the lessor’s agent); or (b) the lessee has failed, for a period of 15 working days, to observe or perform any other covenant, condition, or stipulation on the part of the lessee expressed or implied in the lease. (2) The lessee is not released from liability for the payment of any unpaid rent or for the breach or non-observance of any other covenant, condition, or stipulation referred to in subclause (1) if the lessor cancels the lease in accordance with section 244 and, accordingly,— (a) the lessor peaceably re-enters the leased premises or any representative part of those premises; or (b) the court makes an order for possession of the land in favour of the lessor.
