19 Effect of Act while property is undivided Except as otherwise expressly provided in this Act, nothing in the Act shall— (a) Affect the title of any third person to any property, or affect the power of either spouse or partner to acquire, deal with, or dispose of any property or to enter into any contract or other legal transaction whatsoever as if this Act had not been passed; or (b) Limit or affect the operation of any mortgage, charge, or other security for the repayment of a debt given by either spouse or partner over property owned by him or her and every such instrument shall have the same effect as if this Act had not been passed. Section 19 was amended, as from 1 February 2002, by section 19 Property (Relationships) Amendment Act 2001 (2001 No 5) by inserting the words “ or de facto partner ” after both occurrences of the word “ spouse ” . See Part 9 of this Act as to the transitional and saving provisions. Paragraphs (a) and (b) were amended, as from 26 April 2005, by section 3(2) Property (Relationships) Amendment Act 2005 (2005 No 19) by substituting the word “ partner ” for the words “ de facto partner ” .
