Section 1F — Property (Relationships) Act 1976: Part 3 (application of this Act)

1F Part 3 (application of this Act) (1) Part 3 identifies— (a) which provisions of this Act apply with respect to the division of relationship property while both spouses or partners are alive; and (b) which provisions of this Act apply with respect to the division of relationship property when 1 spouse or partner dies. (2) Part 3 also— (a) sets out how this Act applies in various other circumstances (such as when 1 of the spouses or partners is declared bankrupt): (b) sets out what happens if proceedings are commenced while both spouses or partners are alive, and 1 or both of them die before the proceedings are completed. Part 1 (comprising sections 1A to 1L) was inserted, as from 1 February 2002, by section 6 Property (Relationships) Amendment Act 2001 (2001 No 5). See Part 9 of this Act as to the transitional and saving provisions. Subsection (1)(a) was amended, as from 26 April 2005, by section 3(1) Property (Relationships) Amendment Act 2005 (2005 No 19) by substituting the word “ partners ” for the words “ de facto partners ” wherever they appear. Subsection (1)(b) was amended, as from 26 April 2005, by section 3(2) Property (Relationships) Amendment Act 2005 (2005 No 19) by substituting the word “ partner ” for the words “ de facto partner ” . Subsection (2) was amended, as from 26 April 2005, by section 3(1) Property (Relationships) Amendment Act 2005 (2005 No 19) by substituting the word “ partners ” for the words “ de facto partners ” wherever they appear.
