Section 1H — Property (Relationships) Act 1976: Part 5 (relationship property and creditors)

1H Part 5 (relationship property and creditors) Part 5 sets out how this Act affects the secured and unsecured creditors of the spouses or partners. It deals with matters like— (a) what rights do secured and unsecured creditors have against the spouses or partners, and against property owned by the spouses or partners? (b) to what extent is the share of 1 spouse or partner reduced by the fact that the other spouse or partner has unsecured personal debts? Part 1 (comprising sections 1A to 1L) was inserted, as from 1 February 2002, by section 6 Property (Relationships) Amendment Act 2001 (2001 No 5). See Part 9 of this Act as to the transitional and saving provisions. Section 1H was amended, as from 26 April 2005, by section 3(1) Property (Relationships) Amendment Act 2005 (2005 No 19) by substituting the word “ partners ” for the words “ de facto partners ” wherever they appear. Paragraph (b) was amended, as from 26 April 2005, by section 3(2) Property (Relationships) Amendment Act 2005 (2005 No 19) by substituting the word “ partner ” for the words “ de facto partner ” wherever they appear.
