Section 1J — Property (Relationships) Act 1976: Part 7 (proceedings under this Act)

1J Part 7 (proceedings under this Act) (1) Part 7 — (a) deals with the various powers that a Court can exercise in deciding how property is to be divided between spouses or partners; and (b) sets out the procedures that apply to Court proceedings under this Act; and (c) deals with some general issues. (2) Part 7 deals with matters like— (a) what Court do applications have to be made to? (b) who can apply for a Court order dividing a couple's property? (c) is there any time limit on applying for a Court order? (d) can a Court order be obtained stopping a person from disposing of property? (e) what happens if the spouses or partners attempt to defeat their creditors by disposing of property? Part 1 (comprising sections 1A to 1L) was inserted, as from 1 February 2002, by section 6 Property (Relationships) Amendment Act 2001 (2001 No 5). See Part 9 of this Act as to the transitional and saving provisions. Section 1J was amended, as from 26 April 2005, by section 3(1) Property (Relationships) Amendment Act 2005 (2005 No 19) by substituting the word “ partners ” for the words “ de facto partners ” in both places they appear.
