29 Orders when property subject to hire purchase agreement Where any property which is the subject of an application under this Act is in the possession of either or both spouses or partners under a hire purchase agreement or conditional sale agreement or under an agreement to hire or lease, the Court may make an order vesting the rights and obligations under the agreement in either spouse or partner and any such order shall have effect notwithstanding anything in any agreement. Compare: 1963 No 71 s 62(4) Section 29 was amended, as from 1 February 2002, by section 30(a) Property (Relationships) Amendment Act 2001 (2001 No 5) by substituting the words “ either or both spouses or de facto partners ” for the words “ the husband or the wife or both. ” See Part 9 of this Act as to the transitional and saving provisions. Section 29 was amended, as from 1 February 2002, by section 30(b) Property (Relationships) Amendment Act 2001 (2001 No 5) by inserting, after the word “ spouse ” , the words “ or de facto partner ” . Section 29 was amended, as from 26 April 2005, by section 3(1) Property (Relationships) Amendment Act 2005 (2005 No 19) by substituting the word “ partners ” for the words “ de facto partners ” . Section 29 was amended, as from 26 April 2005, by section 3(2) Property (Relationships) Amendment Act 2005 (2005 No 19) by substituting the word “ partner ” for the words “ de facto partner ” .
