Section 31 — Property (Relationships) Act 1976: Orders in relation to superannuation rights

31 Orders in relation to superannuation rights (1) Where the relationship property to which any application under this Act relates includes property of the kind described in section 8(1)(i) of this Act, the Court may make any order under this Act, or any provision of any such order, conditional on either spouse or partner entering into an arrangement or deed of covenant designed to ensure that the other spouse or partner receives his or her appropriate share of that property, and every arrangement or deed entered into pursuant to any such condition shall have effect according to its tenor. (2) A copy of any arrangement or deed entered into pursuant to subsection (1) of this section may be served on the manager of the superannuation scheme from which the entitlement is derived. (3) Where a copy of any such arrangement or deed is served on any such manager he or she shall, notwithstanding the provisions of any Act, deed, or rules governing the scheme, be bound by the provisions of the arrangement or deed. Subsection (1) was amended, as from 1 February 2002, by section 34(1)(a) Property (Relationships) Amendment Act 2001 (2001 No 5) by substituting the word “ relationship ” for the word “ matrimonial ” . See Part 9 of this Act as to the transitional and saving provisions. Subsection (1) was amended, as from 1 February 2002, by section 34(1)(b) Property (Relationships) Amendment Act 2001 (2001 No 5) by substituting the expression “ section 8(1)(i) ” for the expression “ section 8(i) ” . See Part 9 of this Act as to the transitional and saving provisions. Subsection (1) was amended, as from 1 February 2002, by section 34(1)(d) Property (Relationships) Amendment Act 2001 (2001 No 5) by inserting, after the words “ spouse ” , the words “ or de facto partner ” . See Part 9 of this Act as to the transitional and saving provisions. Subsection (1) was amended, as from 26 April 2005, by section 3(2) Property (Relationships) Amendment Act 2005 (2005 No 19) by substituting the word “ partner ” for the words “ de facto partner ” in both places they appear. Subsection (3) was amended, as from 1 February 2002, by section 34(2) Property (Relationships) Amendment Act 2001 (2001 No 5) by inserting, after the word “ he ” , the words “ or she ” .
