Section 35 — Property (Relationships) Act 1976: Proceedings may be in private

35 Proceedings may be in private (1) Any application or appeal under this Act shall be heard in private if either spouse or partner so desires it. (2) Subject to subsection (1) of this section, where any application is made under this Act to a District Court, the provisions of section 159 of the Family Proceedings Act 1980 shall apply. Compare: 1963 No 72 s 7(2) Subsection (1) was amended, as from 1 February 2002, by section 38 Property (Relationships) Amendment Act 2001 (2001 No 5) by substituting the words “ either spouse or de facto partner ” for the words “ the husband or the wife ” . See Part 9 of this Act as to the transitional and saving provisions. Subsection (1) was amended, as from 26 April 2005, by section 3(2) Property (Relationships) Amendment Act 2005 (2005 No 19) by substituting the word “ partner ” for the words “ de facto partner ” . Subsection (2) was substituted, as from 1 October 1981, by section 189(1) Family Proceedings Act 1980 (1980 No 94).
