Section 35A — Property (Relationships) Act 1976: Restriction of publication of reports of proceedings

35A Restriction of publication of reports of proceedings (1) No person shall publish any report of proceedings under this Act (other than criminal proceedings) except with the leave of the Court which heard the proceedings. (2) Every person who contravenes subsection (1) commits an offence against this Act, and is liable on summary conviction,— (a) in the case of an individual, to a fine not exceeding $1,000: (b) in the case of a body corporate, to a fine not exceeding $5,000. (3) Nothing in this section shall limit— (a) The provisions of any other enactment relating to the prohibition or regulation of the publication of reports or particulars relating to judicial proceedings; or (b) The power of any Court to punish any contempt of Court. (4) Nothing in this section applies to the publication of any of the following: (a) a report in a publication that— (i) is genuinely of a professional or technical nature; and (ii) is intended for circulation among members of the legal or accountancy professions, officers of the Public Service, or persons engaged in commercial occupations: (b) statistical information relating to proceedings under this Act: (c) the results of any genuine research relating to proceedings under this Act, as long as the publication does not include any name or particulars likely to lead to the identification of any of the parties to the proceedings, or of any other person to whom the proceedings relate. Section 35A was inserted, as from 1 October 1981, by section 189(1) Family Proceedings Act 1980 (1980 No 94).
