Section 39B — Property (Relationships) Act 1976: Appeals to Court of Appeal

39B Appeals to Court of Appeal (1) The provisions of the Judicature Act 1908 relating to appeals to the Court of Appeal against a decision of the High Court apply to an order or decision of the High Court under this Act. (2) [Repealed] (3) The High Court or the Court of Appeal may, if it thinks that the interests of justice so require,— (a) rehear the whole or any part of the evidence; or (b) receive further evidence. Sections 39A and 39B were inserted, as from 1 February 2002, by section 43 Property (Relationships) Amendment Act 2001 (2001 No 5). See Part 9 of this Act as to the transitional and saving provisions. The heading to section 39B was amended, as from 1 January 2004, by section 48(1) Supreme Court Act 2003 (2003 No 53) by omitting the words “ and to Privy Council ” . See sections 50 to 55 of that Act for the transitional and savings provisions. Subsection (2) was repealed, as from 1 January 2004, by section 48(1) Supreme Court Act 2003 (2003 No 53).
