Section 100A — Protection of Personal and Property Rights Act 1988: Suspension of attorney's power to act

100A Suspension of attorney's power to act (1) A donor of an enduring power of attorney who has been, but is no longer, mentally incapable may suspend the attorney's authority to act under the enduring power of attorney by giving written notice to the attorney. (2) An attorney whose authority is suspended may not act under the enduring power of attorney unless a relevant health practitioner has certified, or the Court has determined, that the donor is mentally incapable. (3) The suspension does not revoke the enduring power of attorney. (4) Nothing in this section affects the donor's right to revoke the enduring power of attorney while the donor is mentally capable. Section 100A: inserted, on 25 September 2008, by section 15 of the Protection of Personal and Property Rights Amendment Act 2007 (2007 No 90).
