Section 108F — Protection of Personal and Property Rights Act 1988: Termination of trust

108F Termination of trust (1) Where a specified person attains the capacity to manage his or her own affairs while any amount is held on trust for his or her benefit under section 108D , the balance of that amount and of the income from that amount remaining in the hands of the trustee must be paid to the specified person. (2) At any time before the payment is made, the court may order that the whole or any part of the amount must continue to be held on trust under section 108D . (3) Where the trustee has made an application or received notice that an application has been made to the court for an order that the amount must continue to be held on trust, the trustee must not make any payment under this section until the application has been disposed of.
