Section 69 — Protection of Personal and Property Rights Act 1988: Identification of issues

69 Identification of issues (1) If the parties at a pre-hearing conference agree on the nature of the problem for which an order of the Court is sought, and on the solution for that problem, the presiding Judge shall record in writing the terms of the agreement. (2) Where agreement is not reached on all matters, the presiding Judge shall record in writing those matters on which there is agreement and those matters on which there is no agreement. (3) In every case, the presiding Judge shall state in the record whether or not— (a) The person in respect of whom the application is made was present during the pre-hearing conference; and (b) The person was able to understand the nature and purpose of the proceedings; and (c) The person agreed to any matter referred to in subsection (1) of this section. (4) The record made by the presiding Judge under subsection (1) or subsection (2) of this section shall be filed in the District Court in which the relevant application is filed.
