Section 99C — Protection of Personal and Property Rights Act 1988: Attorney as to property must keep records

99C Attorney as to property must keep records (1) An attorney under an enduring power of attorney in relation to a donor's property must keep records of each financial transaction entered into by the attorney under the enduring power of attorney while the donor is mentally incapable. (2) An attorney who fails without reasonable excuse to comply with subsection (1) commits an offence and is liable on summary conviction to a fine not exceeding $1,000. Section 99C: inserted, on 25 September 2008, by section 14 of the Protection of Personal and Property Rights Amendment Act 2007 (2007 No 90).
