104C Particular restrictions for restricted discretionary activities When considering an application for a resource consent for a restricted discretionary activity, a consent authority— (a) must consider only those matters specified in the plan or proposed plan to which it has restricted the exercise of its discretion; and (b) may grant or refuse the application; and (c) if it grants the application, may impose conditions under section 108 only for those matters specified in the plan or proposed plan over which it has restricted the exercise of its discretion. Sections 104A to 104D were inserted, as from 1 August 2003, by section 44 Resource Management Amendment Act 2003 (2003 No 23).
