Section 165W — Resource Management Act 1991: Excluded areas

165W Excluded areas (1) A regional council may, by public notice, identify areas in the coastal marine area in its region as excluded areas. (2) Before identifying an excluded area, the regional council must comply with the consultative requirements in clauses 3 to 3B of Schedule 1, and those clauses apply, with all necessary modifications, as if a proposal to identify an excluded area were a proposed plan. (3) To avoid doubt, any consultation under subsection (2) does not constitute a request for an aquaculture decision under section 186D of the Fisheries Act 1996 . Part 7A (comprising sections 165A to 165ZJ) was inserted, as from 1 January 2005, by section 20 Resource Management Amendment Act (No 2) 2004 (2004 No 103). Subsection (2) was amended, as from 10 August 2005, by section 87 Resource Management Amendment Act 2005 (2005 No 87) by substituting the words “ clauses 3 to 3B of Schedule 1, and those clauses apply ” for the words “ clause 3 of Schedule 1, and that clause applies ” .
