Section 269 — Resource Management Act 1991: Environment Court procedure

269 Environment Court procedure (1) Except as expressly provided in this Act, the Environment Court may regulate its own proceedings in such manner as it thinks fit. (2) Environment Court proceedings may be conducted without procedural formality where this is consistent with fairness and efficiency. (3) The Environment Court shall recognise tikanga Maori where appropriate. (4) The Environment Court may use or allow the use in any proceedings, or conference under section 267 , of any telecommunication facility which will assist in the fair and efficient determination of the proceedings or conference. The words “ Environment Court ” in subsections (1) to (4) were substituted, as from 2 September 1996, for the words “ Planning Tribunal ” pursuant to section 6(2)(a) Resource Management Amendment Act 1996 (1996 No 160).
