Section 312 — Resource Management Act 1991: Notification of application

312 Notification of application (1) The applicant for a declaration shall serve notice of the application in the prescribed form on every person directly affected by the application. (2) Every notice required to be served under this section shall be served within 5 working days after the application is made to the Environment Court. Subsection (1) was amended, as from 7 July 1993, by section 140 Resource Management Amendment Act 1993 (1993 No 65) by inserting the words “ on the Minister and ” . Subsection (1) was amended, as from 10 August 2005, by section 116(1) Resource Management Amendment Act 2005 (2005 No 87) by omitting the words “ on the Minister and ” . See sections 131 to 135 of that Act as to the transitional provisions. The words “ Environment Court ” in subsection (2) were substituted, as from 2 September 1996, for the word “ Tribunal ” pursuant to section 6(2)(a) Resource Management Amendment Act 1996 (1996 No 160).
