Section 318 — Resource Management Act 1991: Right to be heard

318 Right to be heard Except as provided in section 320 (which relates to interim enforcement orders), before deciding an application for an enforcement order, the Environment Court shall— (a) Hear the applicant; and (b) Hear any person against whom the order is sought who wishes to be heard. The words “ Environment Court ” were substituted, as from 2 September 1996, for the words “ Planning Tribunal ” pursuant to section 6(2)(a) Resource Management Amendment Act 1996 (1996 No 160).
